The Most Powerful Contract You May Ever Sign Might Be Attached to Your Passport Application

What if the most powerful contract you ever sign isn’t a mortgage, a marriage license, or a business agreement?

What if it is the document where YOU declare who you are, the standing you claim, the authorities supporting that claim, the evidence you are bringing forward, and the allegiance you affirm?

That is how I look at the Passport Explanatory Statement I teach people to attach to their passport application.

It is not just another piece of paper in the packet. It is the document used to deliberately state the position being claimed rather than leaving the application to stand without that additional declaration.

In the process I teach, the Explanatory Statement is used to move away from the default “U.S. Citizen” classification and place a formal claim to non-citizen National standing into the passport record.

And we just made that document significantly stronger.

The NEW Passport Explanatory Statement Is Done

When Leslie and I began revising the Explanatory Statement, the goal was not to make it longer or bury it under another mountain of citations.

We wanted the authorities to do something.

There is an enormous difference between dropping a statute into a document and clearly explaining why that statute matters to the declaration being made.

So we went back through the statement and tightened the relationship between:

the declaration being made → the authority supporting it → the record being created.

We added additional authorities addressing status, public records, and individual rights.

We strengthened the portions dealing with the claim of non-citizen National status.

And we made the document more intentional from beginning to end.

Because if you are going to put your signature on a declaration this important, every word should earn its place.

Why I Call It a Contract

“Explanatory Statement” is probably one of the most boring names imaginable for what the document actually represents.

Think about what is happening when you sign it.

You are not simply checking boxes on somebody else’s form.

You are making declarations about yourself.

You are identifying the standing you intend to claim in relation to the US Corporation.

You are placing the authorities supporting the declarations directly into the document.

You are bringing forward supporting records.

You are affirming an oath.

And then you are signing your name beneath it.

That is why the Explanatory Statement through is a contract and declaration.

 

And if you believe words create consequences, capacity matters, and records matter, then the language you deliberately place beside your passport application deserves a whole lot more attention than most people ever give it.

Why Attach It to a Passport Application?

Because the passport process creates something more consequential than another document sitting in your filing cabinet.

The Explanatory Statement is submitted as part of the passport process alongside the DS-11 and the supporting records being brought forward.

 

The Explanatory Statement allows you to set your terms.

The DS-11 is completed as part of that process.

The applicant appears for the passport appointment.

And afterward, the passport file can be requested so there is a record of what was submitted and retained.

 

The New Version Makes the Authorities Explain Themselves

One of the biggest changes in this revision is simple:

We stopped allowing citations to just sit there looking impressive.

If an authority belongs in the document, the reader should understand why.

What does it establish?

What declaration does it support?

Why is it relevant to the claim being made?

That makes the new Explanatory Statement not merely more heavily sourced, but more coherent.

And that matters.

Because a long list of statutes does not automatically create a strong declaration.

A strong declaration makes the relationship between the words, the authority, the evidence, and the intended record clear.

That is what we worked to strengthen.
